Please read these Terms of Service ("Terms") carefully before using the mobile applications and services (the "Services") operated by Smoothics e.U ("us", "we", or "our").

1. Acceptance of Terms

By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services and should delete our applications from your device.

2. License to Use

We grant you a personal, non-exclusive, non-transferable, and revocable license to use our Games for your personal, non-commercial entertainment. You acknowledge that you are obtaining a license to use the Services and not ownership of the Services or any virtual items therein.

3. Account & Third-Party Services

To provide game progress synchronization and achievements, our Services integrate with:

  • Google Play Games Services
  • Apple Game Center

By signing into these services through our Games, you agree to their respective terms. We do not store your login credentials (passwords). Your progress is linked to your third-party account. You are responsible for maintaining the security of your device and your accounts.

4. User Conduct & Restrictions

You agree not to:

  • Use cheats, automation software (bots), hacks, or any other unauthorized third-party software to modify or interfere with the Services.
  • Decompile, reverse engineer, or attempt to derive the source code of our Games.
  • Use the Services for any illegal or unauthorized purpose.
  • Exploit bugs or glitches for an unfair advantage.

5. Virtual Items & In-App Purchases

Our Games may include virtual currency or items.

  • No Real-World Value: Virtual items have no monetary value and cannot be exchanged for cash or any other real-world goods.
  • No Refunds: All purchases are final and non-refundable, except where required by the laws of your jurisdiction or the policies of the app store (Google Play/Apple App Store).
  • Management: We reserve the right to manage, regulate, control, or delete virtual items at any time without liability.

6. Third-Party Advertising & Analytics

Our Services use Google AdMob for advertising and Google Firebase for analytics. By using the Services, you acknowledge that these third-party tools may collect data from your device as described in our Privacy Policy. We are not responsible for the content or privacy practices of advertisements displayed by third-party networks.

7. Termination

We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

8. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, SMOOTHICS e.U makes no warranties, express or implied, regarding the availability, accuracy, or reliability of the Services. We do not guarantee that the Services will be uninterrupted or error-free.

9. Limitation of Liability

In no event shall SMOOTHICS e.U be liable for any indirect, incidental, special, or consequential damages (including loss of data or profits) arising out of or in connection with your use of the Services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria (Vienna) without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
